These supplemental terms (the "Mental Health Manager Terms") apply specifically to the Managed Care / Mental Health Manager feature (the "Manager Feature"). They supplement (and do not replace) our general Terms of Use and Privacy Policy. By using the Manager Feature, you confirm that you have read, understand, and agree to these Mental Health Manager Terms.
1. Non-Clinical Service & No Provider–Patient Relationship
The Manager Feature is a structured wellness and accountability support tool. It is not medical care, therapy, or mental health treatment.
Managers are guides/coordinators and are not licensed mental health professionals unless we explicitly state otherwise in writing.
Managers do not provide psychotherapy, diagnosis, prescription, or medical treatment, and they do not make clinical determinations.
Using the Manager Feature does not create a therapist–client, doctor–patient, or other clinical treatment relationship with us, any manager, or any AI tools.
If you need diagnosis, treatment, medication support, or a safety plan, consult a qualified, licensed professional.
2. AI-Assisted Experience
Managers and the Manager Feature may use AI tools to summarize, organize, and draft content based on information you provide.
AI outputs can be incomplete, inaccurate, biased, or inappropriate. You agree to use your own judgment and to verify information before acting on it.
You are responsible for decisions you make based on the Manager Feature or any AI-assisted outputs.
3. No Emergency or Crisis Support; No Duty to Monitor
The Manager Feature is not an emergency, crisis, or hotline service. We do not guarantee response times. You agree that we have no duty to monitor messages for emergencies and no responsibility for delays in responses.
4. Safety & Escalation
If we believe (in our discretion) that there is a risk of harm to you or others, we may take actions we deem appropriate, including: (a) encouraging you to contact emergency services; (b) pausing or terminating access to the Manager Feature; and/or (c) contacting emergency responders or other authorities to the extent we believe is necessary or permitted by law.
You understand that any such actions are discretionary and are not a promise that we will identify or respond to every risk situation.
5. Your Responsibilities
Use the Manager Feature only for lawful, non-emergency wellness support for yourself.
Do not delay or avoid professional care because of anything you see in the Manager Feature.
Provide information that is as accurate and complete as you reasonably can; your results depend on what you share.
Keep your account secure; you are responsible for activity under your account.
Maintain your own copies/backups of any information that is important to you.
6. Data, Privacy, and Visibility
Information you share through the Manager Feature may be visible to an assigned manager and processed by AI tools to provide and improve the feature.
We handle your information in accordance with our Privacy Policy. Where controls exist, you are responsible for choosing settings that match your preferences.
We may retain records of interactions for safety, quality assurance, analytics, fraud prevention, and legal/compliance purposes.
7. Availability; Changes; Termination
We may modify, suspend, or terminate the Manager Feature (or your access to it) at any time, including if we believe it is being misused, creates risk, violates our Terms, or is no longer feasible to offer, subject to applicable law.
8. Disclaimer & Limitation of Liability
The Manager Feature is provided on an "as is" and "as available" basis, without warranties of any kind, to the fullest extent permitted by law.
We do not guarantee any outcomes, improvements, or results.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for decisions you make based on your use of the Manager Feature.
Where liability cannot be excluded, it is limited to the maximum extent permitted by law. Your sole remedy is to stop using the Manager Feature.
9. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold us (and our affiliates, officers, employees, and contractors) harmless from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
Your misuse of the Manager Feature;
Your violation of these Mental Health Manager Terms or our general Terms of Use;
Your reliance on the Manager Feature, manager guidance, or AI-generated content in place of appropriate professional care or emergency services.
10. Updates to These Terms
We may update these Mental Health Manager Terms from time to time. When we do, we will revise the "Last updated" date at the top. Your continued use of the Manager Feature after changes are posted means you accept the updated terms.
